01 Agreement to these terms
These terms govern your use of pixelambit.com (the “Site”), operated by PixelAmbit (“PixelAmbit”, “we”, “us”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
02 Use of the Site
You may use the Site for lawful purposes only. You agree not to misuse the Site, attempt to gain unauthorised access, interfere with its operation, submit false information or use automated tools to scrape or overload it.
03 Quotes and proposals
Information on the Site, including service descriptions and indicative pricing, is provided for general guidance and does not form an offer. Submitting a quote request does not create a contract. Any engagement is governed by a separate written proposal, statement of work or services agreement, which takes precedence over these terms.
04 Pricing and third-party costs
Prices are indicative until confirmed in a written proposal. Unless stated otherwise, advertising spend, software subscriptions, hosting, stock media, premium plugins and other third-party costs are separate and are paid directly by the client or passed through as agreed.
05 Results
Marketing, advertising and search results depend on factors outside our control, including platform algorithms, market conditions and competitor activity. We do not guarantee specific rankings, traffic, leads, sales or return on ad spend. Examples labelled as demo content on the Site are fictional and illustrative.
06 Intellectual property
The Site and its content, including text, design, graphics, logos and code, are owned by or licensed to PixelAmbit and protected by intellectual property laws. You may view and share Site pages for personal or internal business purposes, but you may not copy, modify or reuse the content commercially without our written permission. Ownership of project deliverables is set out in the relevant client agreement.
07 Third-party services and links
The Site may link to or integrate third-party services. We are not responsible for their content, availability or practices, and your use of them is subject to their own terms.
08 Disclaimer
The Site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.
09 Limitation of liability
To the fullest extent permitted by law, PixelAmbit will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (US$100). Liability for client services is governed by the relevant client agreement.
10 Indemnity
You agree to indemnify PixelAmbit against claims, losses and expenses arising from your misuse of the Site or breach of these terms.
11 Privacy
Our Privacy Policy explains how we handle personal information submitted through the Site.
12 Governing law
These terms are governed by the laws of the jurisdiction in which PixelAmbit is registered, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction, unless applicable law requires otherwise.
13 Changes to these terms
We may update these terms from time to time. The “Last updated” date shows when they last changed. Continued use of the Site after changes means you accept the updated terms.
